1. Our Terms and Conditions

This Website is owned and provided by World Golf Competition Pty Ltd (ABN 79 628 675 669) (WGC). These terms and conditions (Terms) govern your access to, and use of, the Website and our Services.
By using the Website, signing up to any mailing list or purchasing any product or Ticket from the Website, you agree that you have read, understood and will be legally bound by these Terms and any notices, disclaimers or other terms and conditions or statements contained on, or linked to, the Website. If you do not agree to be legally bound by these Terms, you must not, and are not permitted to, use this Website, make any purchases and/or otherwise use our Services.
In these Terms, the words “we”, “our” and “us” refer to WGC and its related entities and affiliates and “you” or “your” means the person who agrees to be legally bound by these Terms.

2. Definitions 

Unless expressly provided otherwise, in these Terms:

(a) Competition has the meaning to that term in clause 4.1(a).
(b) Competition Terms means the rules that govern a Competition as provided to you at the time you purchase a Ticket.
(c) Event has the meaning to that term in clause 4.1(a).
(d) Event Terms means the terms and conditions provided to you prior to your participation in an Event that sets out the rules of your participation and the Travel Products supplied for that Event (if any).
(e) Fees has the meaning given to that term in clause 8.1(a).
(f) Force Majeure means an act of God, peril of the sea, accident of navigation, war (including civil war), sabotage, riot, insurrection, civil commotion, coup d’état, national emergency, martial law, fire (including wildfire), explosion, lightning, flood, tsunami, cyclone, hurricane, tornado or other major weather event, earthquake, landslide, volcanic eruption or other natural catastrophe, epidemic, pandemic, national health emergencies, quarantine, outbreaks of infectious disease or any other public health crisis, radiation or radioactive contamination, national strike or other major lack of availability of labour, raw materials or energy beyond the control of the affected party.
(g) Intellectual Property means all intellectual rights of whatever nature (whether or not registered or registrable), including, but not limited to, all copyright, trade names, trademarks, business names, domain names, logos, designs, patents and trade secrets.
(h) Material means the material (including all text, graphics, logos, audio and software) made available on the Website.
(i) Registration Fee means the non-refundable fee charged by WGC from time to time for players to enter a Competition.
(j) Travel Product Terms means the terms and conditions that govern the supply of any Travel Product by a Supplier.
(k) Travel Product means a travel product supplied to you by a Supplier, which may include a flight supplied by a third-party airline, an accommodation booking supplied by a third-party hotel or other accommodation provider, and any other travel related product that may be included in the offering of an Event.
(l) Services  means the services supplied by WGC as described in section 4 and any other service supplied by WGC through the Website from time to time.
(m) Supplier  means a third-party supplier of a Travel Product.
(n) Website  means the website located at: [www.worldgolfcomeptition.com] as well as any electronic sales facilities (including any website and mobile or tablet sites or applications) operated by WGC.

3. Use of the Website

(a) You may not use the Website or any Material, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own website or other third-party service.
(b) You must ensure that your access to, and use of, this Website is not illegal or prohibited by laws which apply to you.
(c) This Website and its Material, including links to third party websites, are provided to you ‘as is’ and your access to, and use of, this Website is at your own risk.
(d) We may, acting reasonably, stop, limit, restrict or withdraw, temporarily or permanently, your access to or use of the Website where we deem those steps to be necessary to protect the Website’s security or our other legitimate interests in connection with the Website or our Services.

4. Our Services 

4.1. Competitions and Events

(a) We run amateur golf competitions globally (each a Competition) that may consist of various rounds of events played over a day or series of days (each an Event).
(b) Global Competitions will consist of rounds of various Events in different regions around the world that are played simultaneously (each a Zone).
(c) It is your responsibility to ensure that you are aware of and available to play in the Events you are entered in subject to the Competition timetable which may change from time to time.
(d) WGC reserves the right to withdraw or restrict your participation in any Event (including future Events) if you do not comply with these Terms or any Event Terms or Competition Terms.

4.2. Travel booking service

(a) We may provide Travel Products such as meals, chartered flights, transfers and hotel accommodation for an Event which will be included in the price of your Ticket. Any Travel Products are offered on an opt-out basis and will be supplied by a third-party Supplier.
(b) The Travel Products supplied will differ for each Event and will be set out in the Event Terms notified to you prior to each Event that you are registered in.
(c) WGC reserves the right to make any changes to the Travel Products provided for an Event by notice in writing to prior to an Event.
(d) By purchasing a Ticket, you acknowledge and agree that WGC is neither a common carrier nor a private carrier and does not supply, and is not responsible for the supply of, any of the Travel Products provided for an Event.

4.3. Authority

(a) When you purchase a Ticket or a product on the Website you agree to these Terms. To the extent that any Event includes Travel Products, you appoint and authorise us to arrange Travel Products to be provided to you with Suppliers (including through third-party aggregators).
(b) You acknowledge and agree that the supply of Travel Products will be subject to the Travel Product Terms imposed by the Supplier(s) in accordance with clause 5 of these Terms. You must read, acknowledge and agree to the Travel Product Terms before accepting any Travel Product.
(c) You acknowledge and agree that:

(i) we are authorised to act on your behalf to book and arrange Travel Products unless you opt-out in accordance with clause 7.5;
(ii) any requests to amend or change the Travel Products arranged by WGC is at the discretion of WGC and the Supplier and we make no guarantees that we will be able to make any amendments including to date, time, room configuration;
(iii) the Travel Products are supplied by the Supplier and not by WGC; and
(iv) subject to these Terms, your legal rights and remedies in connection with the Travel Products provided for an Event are against the Supplier.

5. Your Obligations 

5.1. Your Obligations 

(a) You must only access and use the Services:

(i) to make enquiries about, register for, purchase Tickets for or participate in Competitions, Events or other services and products we may offer from time to time on the Website (Permitted Purpose); and
(ii) in accordance with these Terms.

(b) When you purchase a Ticket or any other product on our Website you must:

(i) have sufficient credit or funds to meet all charges for the Ticket or product you purchase through the Website;
(ii) keep secure any means of identification that WGC provides to you in relation to your Account (as defined in clause 5.3 below) or your specific purchase; and
(iii) ensure you have the necessary documentation to travel (if applicable).

(c) You must not:

(i) access or use the Services:

(A) for any activities which breach any laws, infringe any third party’s rights, or breach any standards, content requirements or codes imposed by any relevant authority; or
(B) for any purpose (commercial or otherwise) other than the Permitted Purpose without the express written permission of WGC;

(ii) reverse or cancel a payment without WGC’s prior written consent, which will not be unreasonably withheld or delayed (including in the event where your payment occurs as a result of fraud or otherwise without your authority);
(iii) resell any Ticket sold on the Website; or
(iv) permit any other person to use your user identification to access the Services or grant a third party the right to access and use the Services.

(d) You are responsible for all matters relating to compliance with the laws and regulations of all immigration authorities of the countries you travel to and from for any Event or Competition.

5.2. Capacity

You must not use the Website or make a purchase unless you are 18 years or older. By making a purchase through the Website, you warrant to us that you are 18 years or older, and that you have the legal right and capacity to purchase a Ticket or any other product through the Website and/or participate in any Event (if applicable).

5.3. Your Account 

(a) You may be required to create an account (Account) to use the Website and access our Services. 
(b) When you create your Account, you may be required to provide:

(i) personal information, including (in some cases) passport details;
(ii) billing information; and
(iii) any other information reasonably required by us to complete your purchase or register you in a Competition.

(c) You are responsible for all use of the Services, and all transactions entered into by means of the Services, under your Account. We take no responsibility for any transactions which may occur as a result of a disclosure by you of your password to third parties, or through any unauthorised access to your personal information unless caused through a fault on our part.
(d) Except to the extent caused by our fraud, negligence or wilful misconduct, you indemnify us from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the Services by you or any other person using your membership identification, Account or password.

5.4. Intellectual Property

(a) Unless otherwise indicated, we own or licence from third parties all Intellectual Property comprised in the Website and the Material.
(b) Your use of the Website and use of or access to any Material does not grant you any right, title or interest in the Website or the Material. You may not reproduce, adapt, modify, display, publish, perform, distribute, store, transmit, decompile or reverse engineer or otherwise exploit any Intellectual Property on our Website or in the Material. In addition, you must not copy the Material to any other server, location or support for publication, reproduction or distribution.
(c) All Intellectual Property rights in the Website are owned by us and/or its licensors (as applicable). The only rights you have to that Intellectual Property are the limited rights to use and access the Website for the Permitted Purpose.
(d) Other trade marks used on the Website that belong to third parties are used with their consent and remain the Intellectual Property of that party.

5.5. Personal Information 

We will collect, store, use and disclose any personal information we collect about you in accordance with our privacy policy, available at www.worldgolfcompetition.com/privacy-policy/. 

6. Competitions

6.1. Tickets

(a) To enter a Competition, you must create an Account, agree to the Competition Terms and Event Terms (if applicable), pay the Registration Fee and purchase a ticket (Ticket).
(b) By purchasing a Ticket, you agree to be bound by these Terms as well as any specific terms and conditions notified at the time of Ticket sale including any Event Terms or Competition Terms.
(c) By purchasing a Ticket on behalf of someone else, you represent that you have authority to purchase that Ticket on their behalf and that they agree to be bound by these Terms and any other terms and conditions notified at the time of sale, including the Competition Terms or Event Terms.
(d) These Terms also apply to Tickets issued by an authorised ticket seller (if any). To the extent of any inconsistency, these Terms, and any other conditions of sale relating to the specific Competition notified at the time of sale, will prevail.

6.2. Progression in Competition

(a) Each Ticket will provide the player named with entry to:

(i) the first round Event of the selected Zone for a Competition; and
(ii). if the player progresses subject to the Competition Terms, entry to subsequent Events of the Competition.

(b) If you progress in the Competition:

(i) you will be notified by WGC by email as soon as possible after the Event and your Ticket will automatically be applied to the next Event in your Zone or the final (as applicable);and
(ii) you may be provided additional Event Terms for the next Event, including an option to opt-out of any Travel Products supplied for that Event. If you do not accept the Event Terms (if any) you will not be registered for the Event and may be disqualified from the Competition by WGC.

6.3. Participation in an Event

(a) Unless otherwise provided, a valid Ticket must be produced to gain entry to each Event.
(b) Late arrival for Events or other programs may result in non-admittance.
(c) Ticket holders must produce valid identification at point of entry if requested.

7. Travel Products

7.1. Travel Product Terms

(a) You acknowledge and agree that Suppliers and/or third-party aggregators may impose their own terms and conditions in relation to their Travel Products that will apply in addition to these Terms and any Competition Terms or Event Terms (Travel Product Terms). We will take reasonable steps to alert you to the Travel Product Terms and provide you with an electronic link or other means of access to review the full Travel Product Terms prior to you participating in an Event.
(b) You must accept and agree to the Travel Product Terms from the applicable Supplier and/or third-party aggregator to complete your registration for an Event. The Travel Product Terms contain important information regarding your rights and obligations in relation to the Travel Products, including in relation to carriage and limitations of liability. You should carefully read the Travel Product Terms specific to the applicable Travel Products before deciding whether to accept the Travel Products or to opt-out.

7.2. Flights

(a) Any Travel Products that comprise a flight supplied by an airline will be supplied by the airline(s) selected by WGC (Airline).
(b) Flight fulfilment is provided by the Airline.
(c) If an Event you are registered for includes flights as a Travel Product and you have not opted-out, you acknowledge and agree that:

(i) WGC cannot control and is not responsible for subsequent changes to Airline scheduled departure times, departure dates or flight cancellations; and
(ii) if a flight is cancelled or delayed by an Airline and WGC is unable to arrange alternative transport prior to the scheduled Event, WGC has no liability due to your non-attendance and reserves the right to withdraw you from the Event and/or Competition.

7.3. Hotels

(a) Any Travel Product that includes accommodation is supplied by the applicable accommodation Supplier and will be arranged by WGC.
(b) You acknowledge and agree that WGC cannot control and is not responsible for any subsequent changes made by the accommodation Supplier to the accommodation once booked for you for an Event, including but not limited to, any requests made by you in relation to the included room or suite location, or room inclusions or exclusions.

7.4. Exclusions

You will only be provided with the Travel Products expressly stated in the Event Terms. Notwithstanding that Travel Products may be offered for an Event, you acknowledge and agree that none of the following will be included with your Ticket:
(a) flights and other transfers to the Event (except where expressly stated);
(b) beverages and meals (except where expressly stated);
(c) passport and visa fees;
(d) insurance;
(e) laundry and phone calls;
(f) items of a personal nature;
(g) excess baggage;
(h) expenses;
(i) fees or costs incurred in case of illness or of refusal of entry; and
(j) detention in, or expulsion or repatriation from a country or part of a country,
and that we are not liable for any expense, costs or loss incurred in relation to any of the items listed above. You agree not to hold WGC responsible for any such things.

7.5. Opting-Out

(a) Once you are registered for an Event, you will be contacted via email with the Event Terms, including details of the Travel Products that will be provided for the Event.
(b) If you do not wish to use any of the Travel Products supplied, you must click the link in the email to opt out or contact us at https://worldgolfcompetition.com/contact/ [within the period notified in the Event Terms].  
(c) If you opt-out of any Travel Products, there will be no reimbursement or reduction in the price of your Ticket.

 

8. Payments and Refunds

8.1. Pricing

(a) Prices are listed on the Website and, unless otherwise specified, are in the currency of your home location as notified to us at the time you sign up for an Account. We may also from time to time advertise discounts and promotions on the Website.
(b) Prices for Tickets are fixed once your registration at an Event has been confirmed or you have paid a Deposit.

8.2. Payment Terms for Tickets

(a) Once you have decided which Competition you would like to participate in, you must select:

(i) the Zone (if any);
(ii) the specific Event that you would like to be registered in to begin the Competition; and
(iii) the number of Tickets,
on our Website.

(b) Once you have selected the Ticket(s), you will be directed to the Event Microsite. The Event Microsite will provide specific information about the Event and form to complete your ticket purchase. This form will contain a link to the Competition Terms, Privacy Policy and Terms and Conditions and show you the total of the Registration Fee(s) and the full price for all Ticket(s) selected. The full price of the Ticket(s) and the Registration Fee is referred to in these Terms as the Fees.
(c) Having reviewed the Fees as shown in the Event Microsite, you may make your purchase by clicking Pay Now.
(d) To complete the purchase of any Ticket, you will be required to pay a Registration Fee to reserve a ticket and the outstanding fees to confirm and secure your ticket. The outstanding Fees may be paid upfront or on a payment plan on the terms set out in the payment section of the Cart.
(e) Notwithstanding clause 8.2(d):

(i) if an instalment due and payable under a payment plan is not received within 30 days of the due date; or
(ii) the total Fees for a Ticket have not been paid in full at least 90 days prior to your selected Event in the selected Zone of the Competition,
we may, after notice in writing to you, revoke your entry or withdraw you or the player associated with the Ticket from the Competition.

(f) By clicking “Pay Now”, you consent to:

(i) the Registration Fee and any other Fees payable being charged to the credit card, debit card or other payment option that you provide at the time you make your purchase; and
(ii) WGC supplying your identification information (including personal information) to relevant Suppliers and third-party aggregators who supply the Travel Products provided for an Event in accordance with our privacy policy.

(g) Your registration in an Event or a Competition is not confirmed until confirmation is provided to you by WGC. We reserve the right to accept or reject your order for a Ticket for any reason (or no reason) at any time after that order has been made, including, but not limited to, the unavailability of any Ticket, an error in the price or product or service description, or an error in your order.
(h) Except where caused by us, we are not responsible for lost or stolen booking confirmations or fraudulent use of the booking confirmation reference numbers.

8.3. Change of Mind and Refunds

(a) Registration Fees are non-refundable.
(b) Unless otherwise provided, Tickets have a 30 day cooling-off period, and any Fees paid (excluding the Registration Fee) will be refundable if cancelled during that time. Upon confirmation of the cancellation request within the cooling-off period, WGC will provide a refund and the Ticket will be cancelled.
(c) All Tickets are non-refundable after the 30 day cooling-off period. If your circumstances change and you can no longer participate in a Competition after that period, you may be able to exchange your Ticket(s) if your Ticket can be resold prior to the first scheduled Event. Please contact WGC if you would like to resell your Ticket.
(d) If you have selected the incorrect Zone or Event or would like to play in a different Event, you may request to have your Ticket transferred to a different Event in the same Zone for the same round of that Competition, provided that such request is made at least 90 days prior to the scheduled Event. We will use our reasonable endeavours to change that Ticket, but we make no representation that we will be able to do this.
(e) If we change or cancel your Ticket, we will send a confirmation email to your nominated e-mail address.
(f) A change in personal circumstances does not entitle you to a refund of the Fees or to the return or exchange of the Ticket unless otherwise determined in the sole discretion of WGC.
(g) You (or the Ticket holder, as applicable) will not be refunded in whole or in part under any circumstances including, but not limited to, you:

(i) being asked or forced to leave an Event; or
(ii) deciding not to attend any portion of an Event.

8.4. Resale of Tickets

1. Unless permitted at the sole discretion of WGC, Tickets are non-transferable and cannot be used for any other Competition or Event.

9. Travel Disclaimers 

9.1. Travel requirements

1. Upon purchasing a Ticket, you acknowledge and agree that your participation and progression in a Competition may require you to travel domestically and internationally.

9.2. Travel arrangements

(a) If transfers or flights are not provided for an Event, it is your responsibility to ensure that you have arranged appropriate transport to any Event that you are registered for.
(b) WGC has no liability due to non-attendance of a player including, but not limited to, due to a delayed flight, missed flight or connection or failure to obtain appropriate transportation to an Event and reserves the right to withdraw players from a Competition.

9.3. Passports and Visas

(a) It is your responsibility to ensure that you have a valid passport and to procure a visa and comply with entry requirements of overseas countries you are intending to visit in connection with your participation in an Event.
(b) We accept no responsibility if you are refused entry into any country/countries of your destination in connection with an Event and reserve the right to revoke your Entry to an Event or disqualify you from a Competition if you are unable to participate in any Event because you are refused entry into any country/countries.

9.4. Travel requirements

We suggest you check the applicable travel advisories relevant to those countries you are travelling to before travelling.

10. Insurance

(a) Immediately after you are registered for an Event that is interstate or overseas, you should arrange your own travel insurance, including for events that occur after your departure date. You agree not to hold us responsible for any decision made by any insurer, or the requirements of any overseas country or governmental authority or overseas laws or policies, in connection with the insurance that we or you arrange.
(b) WGC does not hold an Australian Financial Services Licence and is not authorised to advise you in relation to, or arrange, travel insurance or any other financial product on your behalf. We may, from time to time, refer you to a licenced insurer via a hyperlink on our Website, which enables you to deal directly with the insurer.

11. COVID-19

1. COVID-19 requirements vary from country to country and region to region and you may be required to be fully vaccinated against the COVID-19 virus and provide evidence of such vaccination. Evidence of negative COVID-19 tests may also be required. Airlines and other transport providers may also have separate requirements. It is your responsibility to ensure that you comply at all times with those requirements.

12. Force Majeure

(a) WGC reserves the right to cancel or postpone any Event or Competition due to a Force Majeure.  
(b) If an Event is cancelled due to a Force Majeure, WGC will use reasonable endeavours to reschedule the Event or register you in another equivalent Event to enable your participation in the Competition. 
(c) If an Event is unable to be rescheduled, WGC will provide alternative services including but not limited to credits for accommodation and travel of equivalent value of the Travel Products.  

d) If: 

i) the rescheduled Event is unable to commence due to a Force Majeure; or 

ii) the alternative services or credits are unable to be provided,  

WGC will refund all Fees less the non-refundable Registration Fees. 

e) If a participant suffers a debilitating injury or illness or dies in the period between entering the Competition and the commencement of their first registered Event for the Competition, WGC will refund all Fees. 

f) Notwithstanding clause 13(a), WGC shall be under no liability to you in respect of anything that, if not for this provision, would or might constitute a breach of these Terms, where this arises out of a Force Majeure.  

13. Liability

13.1. Limitation of liability

(a) To the maximum extent permitted by law, you acknowledge and agree we will not be liable to any person for, and you forever release and discharge us from any claims that you have now or may have against us for any direct, indirect, special, consequential or other damages that result from, are connected with, arise out of, or are incidental to:

(i) your access or use of, or your inability to access or use this Website, part of this Website or any other website, including viruses or other malicious computer code, unauthorised use of your user information, or the accuracy, completeness, suitability or currency of any information or Materials on the Website;
(ii) your use of any Travel Products;
(iii). your participation in a Competition or an Event; or
(iv) a Ticket, including the ordering, delivery and use of a Ticket.

(b) In the event of a breach by WGC of a condition, warranty or obligation under these Terms, to the maximum extent permitted by law, our liability for such breach is limited to:

(i) reimbursement of any charges deducted in error; or
(ii) refund of charges paid for a Ticket, or any product sold on our Website from time to time,
as determined by WGC in its absolute discretion.

(c) Our liability is limited to the extent that it is caused, or contributed to, by you.

13.2. Indemnity

Except to the extent directly caused by us, you agree to indemnify us and our officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses (including losses that we suffer under our underlying contracts with Suppliers and/or third-party aggregators), damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees which arise as a result of or in connection with:

(a) your conduct when using the Website or purchasing a Ticket;
(b) your inability to access or use, our Website, part of our Website or any other website, including viruses or other malicious computer code, unauthorised use of your user information, or the accuracy, completeness, suitability or currency of any information or contents;
(c) your breach of these Terms or the documents referenced herein;
(d) your breach of any Travel Product Terms, Competition Terms or Event Terms;
(e) any omissions or failures by you to do something required in connection with your use of the Website, purchase for a Ticket or participating in or enjoying any Competitions, Events or Travel Products;
(f) any unlawful actions or behaviours while participating in or enjoying any of the Competitions, Events or Travel Products;
(g) your breach of any law or the rights of a third party; or
(h) your improper or unlawful use of our Services or the Website.

14. Website

14.1. Information on the Website

(a) Some of the Material is provided by Suppliers and other advertisers. To the extent reasonably possible, we will take steps to ensure that Material provided by Suppliers and third parties is accurate. However, we are not responsible for that information and cannot guarantee its accuracy.
(b) The Website and Material is subject to amendment.

14.2. Links to third party websites

The Website may include links to other websites, content or resources. You acknowledge that we have not reviewed any of these third party websites, content or resources and we are not responsible for the material contained therein.

14.3. Disclaimer

(a) To the maximum extent permitted by law, we do not make any warranties or representations, whether express or implied, that our Website or any websites that are linked or your access to or use of them will be uninterrupted, secure or error free, that any defects in the Website will be corrected or that the Website is free of viruses or other malicious computer code.
(b) To the maximum extent permitted by law, we do not make any warranties or representations, whether express or implied, that any Materials, the information on our Website or information on website(s) that we link to is accurate, complete, suitable or current.

15. General

15.1. Changes to these Terms

We reserve the right to amend these Terms at any time. If we make amendments to any of these Terms, will post the amended Terms on the Website. You should visit the Website periodically to review these Terms. Amendments will be effective immediately on publication on the Website. Your continued use of the Website following such publication will constitute an agreement by you to be bound by the Terms as amended.

15.2. Waiver

Any failure or delay by us to enforce or exercise a power, right or provision of these Terms will not constitute a waiver of those powers, rights or provisions, and the exercise of a power or right by us does not preclude our ability to exercise that or any other power or right in the future.

15.3. Severability

If any provision of these Terms is void or unenforceable, it may, to the extent possible, be severed from these Terms without affecting the enforceability of other provisions.

15.4. Governing Law 

(a) These Terms are governed by, and must be construed according to, the law in force in the State of Victoria, Australia. The Courts in that State will have the exclusive jurisdiction to determine disputes in relation to these Terms.
(b) The Website may be accessed in Australia and overseas. We make no representations that the Website complies with the laws of any country outside Australia, and if you access the Website from outside Australia, you do so at your own risk.
